Are you ready for The European Accessibility Act (EAA)?

The European Accessibility Act (EAA) is a landmark regulation by the European Union aimed at ensuring that digital and physical products and services are accessible to people with disabilities. Set to take effect on June 28, 2025, the EAA will require digital platforms, including e-commerce websites and mobile applications, to meet specific accessibility standards. This legislation is intended to promote an inclusive digital landscape across the EU, making sure all consumers, including those with disabilities, can fully engage with online services and digital products.

What the EAA Will Focus On

The EAA outlines accessibility requirements for several keyareas, focusing on enabling equal access across all digital touchpoints. These requirements will include:

  • E-commerce Websites: Digital storefronts must ensure that all users can easily navigate, understand, and engage with content. This includes having     well-contrasted colour schemes, providing text alternatives for images, and ensuring seamless keyboard navigation for those who may not use a mouse.
  • Mobile Applications: Apps must adhere to WCAG 2.1 standards, ensuring compatibility with screen readers, and voice commands, as well as offering an accessible user interface. Each element should be operable for individuals using assistive devices and must support alternative input methods.

The EAA builds upon existing guidelines such as WCAG (WebContent Accessibility Guidelines) 2.1 and EN 301 549, a European standard for digital accessibility. By incorporating these standards, the EAA creates aconsistent and thorough framework that all digital platforms operating within the EU are expected to follow.

Consequences of Non-Compliance

Businesses that fail to meet EAA accessibility requirements by the 2025 deadline face multiple risks:

  • Financial Penalties: Each EU member state will enforce penalties, which may range from fines to other legal sanctions, depending on the severity of the non-compliance. This financial impact can vary but is intended to be a strong deterrent against neglecting accessibility.
  • Legal Actions and Lawsuits: Non-compliant businesses could face lawsuits from advocacy groups or individual users, potentially leading to costly     settlements and mandated accessibility improvements.
  • Exclusion from Public Procurement Opportunities: Accessibility will likely become a key criterion in public sector procurement, meaning non-compliant     businesses may be barred from participating in these opportunities, reducing business growth potential.
  • Reputational     Damage: In today’s socially conscious consumer environment, failing to prioritise accessibility can harm a brand’s reputation. Companies that embrace accessibility, however, build goodwill, trust, and loyalty among their audiences, especially those who value inclusivity.

Why Digital Businesses Should Act Now

The EAA’s upcoming requirements offer digital businesses achance to create better, more inclusive user experiences while avoiding thecostly pitfalls of non-compliance. Here’s why acting sooner rather than lateris critical:

  • Broader Market Reach: Making digital platforms accessible opens up the business to a wider audience, including millions of users with disabilities who will have full access to browse, shop, and interact online. Companies that implement accessible designs now are likely to see an increase in market reach and customer satisfaction.
  • Enhanced User Experience for All: Accessibility improvements often result in a better overall user experience. For instance, features like text     alternatives and clear navigation not only benefit users with disabilities but also improve usability for everyone. Enhancing accessibility can make     platforms more intuitive, helping all users engage more seamlessly.
  • Risk Mitigation: Starting the compliance process now reduces the risk of rushed, last-minute changes that may miss essential requirements. Early     compliance efforts give businesses the time needed for careful testing and adjustments, ensuring a more robust approach to meeting EAA standards.
  • Positive Brand Reputation: Companies that are proactive about accessibility position themselves as leaders in inclusivity, fostering trust and loyalty     with socially aware consumers. This proactive stance can also be a strong differentiator in competitive markets where accessibility and inclusivity are becoming key purchasing factors.
